With Definitions Like These...
The Town of Austerlitz has released it's proposed Zoning Law.
I studied Planning and Zoning in College, majoring in Geography.
I chaired the Austerlitz Planning Board.
I've been involved in a fair amount of land development for clients during my years as a Realtor.
And I've learned that when you use definitions like this, you're in big trouble....
SPECIMEN TREE: A native, introduced or naturalized tree which is important
because of its impact on community character, its significance in the historic/cultural landscape or its value in enhancing the effects of wildlife habitat. Any tree with a dbh of 16” or larger is eligible to be considered a specimen tree.
Trees that have a small height at maturity or are slow growing, such as flowering dogwood with a dbh of 4” or larger are eligible to be considered specimen trees.
Imagine the fun interpreting which trees are "important". Imagine the discussions, the haggling, the complete waste of time that ensues as you sit before the Planning Board or the Zoning Board of Appeals and all you wanted to do was put in a swimming pool.....
Of the people, by the people, FOR the people....
